Nous vous proposons de faire le point sur les r\u00e9gimes existants, leurs caract\u00e9ristiques et sur l\u2019\u00e9volution propos\u00e9e par la loi finances de janvier 2022.<\/p>\n<h2><span style=\"font-weight: 400\">Les locations meubl\u00e9es<\/span><\/h2>\n<h3><span style=\"font-weight: 400\">R\u00e9gime fiscal du propri\u00e9taire bailleur\u00a0 : le BIC<\/span><\/h3>\n<p><span style=\"font-weight: 400\">Les locations d\u2019appartements ou de maisons meubl\u00e9es sont g\u00e9n\u00e9ralement soumises au r\u00e9gime fiscal BIC. Derri\u00e8re cet acronyme se cache le terme de B\u00e9n\u00e9fices Industriels et Commerciaux, appel\u00e9 aussi r\u00e9gime micro-entreprise ou micro-foncier. Celui-ci s\u2019applique lorsque les revenus locatifs atteignent au maximum 72 600 \u20ac par an. Ces recettes incluent les loyers et les charges. Une fois ces montants connus, le revenu net imposable est obtenu avec un abattement forfaitaire de 50 %.\u00a0<\/span><\/p>\n<h3><span style=\"font-weight: 400\">LMNP ou LMP ?<\/span><\/h3>\n<p><span style=\"font-weight: 400\">Dans le cas d\u2019une location meubl\u00e9e, le propri\u00e9taire bailleur peut d\u00e9clarer son bien en deux cat\u00e9gories :\u00a0<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">soit une LMNP pour Location Meubl\u00e9e Non Professionnelle,<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">soit une LMP pour Location Meubl\u00e9e Professionnelle.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400\">Pour d\u00e9clarer un bien en LMP, il faut obligatoirement respecter les conditions suivantes :\u00a0<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Le total des loyers (avec taxes et charges) doit \u00eatre sup\u00e9rieur \u00e0 23 000 \u20ac sur un an.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Le total des loyers doit \u00eatre sup\u00e9rieur au montant total des autres revenus du foyer fiscal.\u00a0<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400\">Si une seule de ces conditions vient \u00e0 manquer, le bailleur passe alors en statut de loueur en meubl\u00e9 non professionnel.\u00a0<\/span><\/p>\n<h3><span style=\"font-weight: 400\">Le r\u00e9gime r\u00e9el<\/span><\/h3>\n<p><span style=\"font-weight: 400\">Si les d\u00e9penses d\u00e9ductibles de la location (frais d\u2019assurance, taxes et int\u00e9r\u00eats d\u2019emprunt) sont sup\u00e9rieures \u00e0 l&rsquo;abattement forfaitaire, il est alors possible de choisir le r\u00e9gime r\u00e9el. Attention, cette option est \u00e0 la fois irr\u00e9vocable pendant deux ans et renouvel\u00e9e tacitement chaque ann\u00e9e. De plus, dans le cas o\u00f9 les revenus locatifs d\u00e9passent 72 600 \u20ac, le r\u00e9gime r\u00e9el est appliqu\u00e9 automatiquement. Le revenu net du r\u00e9gime r\u00e9el est calcul\u00e9 apr\u00e8s d\u00e9duction de certaines d\u00e9penses.\u00a0<\/span><\/p>\n<h4><span style=\"font-weight: 400\">Des documents obligatoires<\/span><\/h4>\n<p><span style=\"font-weight: 400\">Pour bien choisir son r\u00e9gime fiscal, un propri\u00e9taire bailleur doit savoir qu\u2019en optant pour le r\u00e9gime r\u00e9el, plusieurs documents doivent \u00eatre obligatoirement et pr\u00e9cis\u00e9ment tenus :\u00a0<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">un compte de r\u00e9sultat,\u00a0<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">un bilan,\u00a0<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">et des tableaux d\u2019immobilisations et d\u2019amortissements.<\/span><\/li>\n<\/ul>\n<h4><span style=\"font-weight: 400\">La d\u00e9duction des charges<\/span><\/h4>\n<p><span style=\"font-weight: 400\">Dans le cas du r\u00e9gime r\u00e9el, le bailleur peut d\u00e9duire certaines charges avant d\u2019effectuer le calcul de son imp\u00f4t sur le revenu :\u00a0<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Les taxes et int\u00e9r\u00eats d\u2019emprunt,<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">les honoraires de syndic et d\u2019expertise comptable,<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">et les frais d\u2019assurance.<\/span><\/li>\n<\/ul>\n<h4><span style=\"font-weight: 400\">R\u00e9gime fiscal du propri\u00e9taire bailleur : important<\/span><\/h4>\n<p><span style=\"font-weight: 400\">Il faut pr\u00e9ciser que le propri\u00e9taire doit \u00e9galement pr\u00e9voir l\u2019amortissement de son bien dans le cadre du r\u00e9gime r\u00e9el. Celui-ci se calcule en divisant la valeur d\u2019origine par sa dur\u00e9e d\u2019usage. Par exemple, un bien mobilier s\u2019amortit sur 10 ans maximum et un bien immobilier jusqu\u2019\u00e0 40 ans.<\/span><\/p>\n<h2><span style=\"font-weight: 400\">R\u00e9gime fiscal du propri\u00e9taire bailleur pour les locations vides<\/span><\/h2>\n<p><span style=\"font-weight: 400\">Les locations de bien immobiliers vides sont soumises au r\u00e9gime des revenus fonciers. Ainsi, deux cas de figure peuvent se pr\u00e9senter :\u00a0<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Jusqu\u2019\u00e0 15 000 \u20ac de revenus locatifs par an, le r\u00e9gime du micro-foncier s\u2019applique automatiquement. Ici, le revenu net imposable est calcul\u00e9 apr\u00e8s la d\u00e9duction d\u2019un abattement forfaitaire de 30 %.<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Au-del\u00e0 de 15 000 \u20ac de revenus locatifs par an, c\u2019est le r\u00e9gime r\u00e9el qui s&rsquo;applique. Puis, le revenu net imposable s&rsquo;obtient apr\u00e8s d\u00e9duction de certaines d\u00e9penses comme :\u00a0<\/span>\n<ul>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">les travaux am\u00e9lioration,\u00a0<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">les int\u00e9r\u00eats d\u2019emprunt,<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">la taxe fonci\u00e8re,\u00a0<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">les frais de gestion,\u00a0<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">les charges de copropri\u00e9t\u00e9,\u00a0<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">et les honoraires de syndic.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><span style=\"font-weight: 400\">Bon \u00e0 savoir ! Dans le cas du r\u00e9gime micro-foncier, si les d\u00e9penses d\u00e9ductibles sont sup\u00e9rieures \u00e0 l&rsquo;abattement forfaitaire, le propri\u00e9taire peut choisir le r\u00e9gime r\u00e9el. Cette option est irr\u00e9vocable pendant 3 ans et est automatiquement renouvel\u00e9e tous les ans.<\/span><\/p>\n<h2><span style=\"font-weight: 400\">Une nouveaut\u00e9 depuis janvier 2022<\/span><\/h2>\n<p><span style=\"font-weight: 400\">Du moment o\u00f9 toutes les conditions mentionn\u00e9es ci-dessus sont respect\u00e9es, il est possible d\u2019opter pour le r\u00e9gime BIC ou le r\u00e9gime r\u00e9el. Ce choix peut se faire \u00e0 partir de la premi\u00e8re ann\u00e9e de location ou en cours d\u2019activit\u00e9. Jusqu\u2019\u00e0 fin 2021, un propri\u00e9taire pouvait passer d\u2019un r\u00e9gime BIC \u00e0 un r\u00e9gime r\u00e9el. Pour ce faire, il devait imp\u00e9rativement effectuer sa demande avant le premier f\u00e9vrier. Toutefois, cela emp\u00eachait souvent les propri\u00e9taires d\u2019avoir une bonne vision de l\u2019exercice pr\u00e9c\u00e9dent.<\/span><\/p>\n<p><a href=\"https:\/\/www.economie.gouv.fr\/cedef\/investissements-locatifs-evolutions-2022\"><span style=\"font-weight: 400\">La loi finances<\/span><\/a><span style=\"font-weight: 400\"> a modifi\u00e9 ce point depuis le mois de janvier 2002. Ainsi, il est d\u00e9sormais possible pour un propri\u00e9taire bailleur de changer de r\u00e9gime et de b\u00e9n\u00e9ficier d\u2019un d\u00e9lai suppl\u00e9mentaire. Il peut effectuer sa demande de changement en mai ou en juin selon le d\u00e9partement.
